Overview
Certain grounds of inadmissibility or deportability can prevent a person from obtaining a visa, green card, or admission to the United States. In many cases, a waiver allows an applicant to ask the government to forgive a specific ground so that their case can move forward.
Common waivers
Examples include waivers for unlawful presence, certain misrepresentations, and certain criminal grounds, as well as the provisional unlawful presence waiver (which allows some applicants to obtain a waiver before departing the U.S. for consular processing). Many waivers require showing extreme hardship to a qualifying U.S. citizen or lawful permanent resident relative.
