Overview
Adjustment of Status (AOS) is the process that allows certain individuals already inside the United States to apply for lawful permanent residence (a green card) without having to return to their home country for consular processing. The application is filed with U.S. Citizenship and Immigration Services (USCIS) using Form I-485.
Who may qualify
To adjust status, an applicant generally must have been inspected and admitted or paroled into the U.S., have an immigrant visa immediately available (through family, employment, or another category), and be admissible to the United States. Certain applicants may also pursue related benefits such as work authorization (EAD) and advance parole travel documents while the application is pending.
